Welcome to IVOX™ MUSIC! These Service Terms of Use ("Terms") govern your access to and use of the IVOX MUSIC. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

IVOX™ MUSIC a trade name of IVOX MUSIC LLC, together with its affiliates and/or Licensee(s), (collectively hereinafter "IVOX MUSIC"), operates www.ivoxmusic.com, and www.ivox.music website(s), television, radio, video on demand, mobile applications, and streaming services (collectively, the "Service").

By accessing or using the Service and this website (the “Site”), you hereby accept and agree to comply with these Terms and Conditions of Use. You acknowledge your understanding that these Terms and Conditions of Use constitute a binding agreement between you and IVOX MUSIC (sometimes referred to as “us”, “we”, or “our”) that governs your access and use of the Site and Service, which includes any images, text, illustrations, designs, icons, photographs, programs, sounds, audio, recorded music, music clips, downloads, moving pictures, music videos, films, video clips, graphics, user interfaces, visual interfaces, information, data, tools, products, written materials, services and other content (together, "Content"), including but not limited to the design, structure, selection, coordination, expression, impression, and arrangement of the Content available on or through the Site and Service.

1. Acceptance of Terms

IVOX MUSIC provides an audiovisual platform for music, music videos, streaming films, music-based TV shows, and other audiovisual content ("Content"). These Terms apply to all users of the Service, including visitors, registered users, and subscribers. We may update these Terms from time to time, and we will notify you of significant changes via email or through the Service. Your continued use of the Service after such updates constitutes acceptance of the revised Terms.

2. Limited Right to Use:

IVOX MUSIC grants you a limited right to use the Site and Service. Your right to use the Site and Service is subject to your agreement to abide by these Terms and Conditions of Use in their entirety, as well as any other additional rules, procedures, policies, terms or conditions that govern all or any portion of the Site and Service. At any time and for any reason IVOX MUSIC may revoke your right to use all or any portion of the Site and Service.

3. Eligibility

To use the Service, you must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

IVOX MUSIC reserves the right to suspend or terminate your account if we suspect any breach of these Terms or unauthorized activity.

4. Subscription and Payment

4.1 Subscription Plans

IVOX MUSIC is a free ad supported Service and offers ad free subscription plans that provide access to the Service for a recurring fee. Details of available plans, including pricing and features, are available on our Site and via other Apps.

4.2 Payment

If you subscribe to a subscription plan, you agree to pay all fees associated with your subscription using a valid payment method. Payments are processed through third-party payment processors, and you authorize us to charge your chosen payment method for the subscription fee. Fees are non-refundable except as required by law or as specified in our refund policy.

4.3 Billing

Subscriptions renew automatically unless canceled. You may cancel your subscription at any time through your account settings, but cancellation will take effect at the end of the current billing cycle.

4.4 Free Trials

We may offer free trials. If you do not cancel before the trial ends, your payment method will be charged for the applicable subscription fee.

5. Use of the Service

5.1 License

Subject to these Terms, IVOX MUSIC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

5.2 Restrictions

You agree not to:

● Copy, reproduce, distribute, or publicly display any Content except as permitted by the Service.

● Use the Service for any illegal or unauthorized purpose.

● Attempt to reverse-engineer, decompile, or otherwise interfere with the Service.

● Share your account with others or allow multiple users to access the Service under a single account unless expressly permitted.

Content on IVOX MUSIC may vary by region and is subject to change. We do not guarantee the availability of specific Content or features.

6. Intellectual Property of Materials on Site and Service:

6.1 Content, Trademarks, and Other Materials

All Content, trademarks, and other materials on the Service are owned by IVOX MUSIC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use these materials except as expressly permitted by these Terms.

6.2 Content Downloads

You may download or copy Content only to the extent such download is expressly permitted in writing on the Site or Service. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying. You may not reproduce (except as noted above), publish, broadcast, transmit, distribute, disseminate, display, modify, create derivative works from, offer for free, sell or participate in any sale of or exploit in any way, in whole or in part, any of the Content, the Site, Service, or any related software or application.

6.3 IVOX™ MUSIC Trade Name

"IVOX™ MUSIC" is the trade name for IVOX MUSIC LLC. Nothing on the Site or Service shall be interpreted as granting any license or right to use any image, trademark, trade dress, logo or service mark on the Site or Service. Anything transmitted to the Site or Service by you that is not your own copyrighted material becomes IVOX MUSIC’s property and may be used by us for any lawful purpose. IVOX MUSIC reserves all rights with respect to use of copyright and trademark ownership or licensure to use of all material on the Site and will enforce such rights to the full extent of the law.

6.4 Contents Copyrights, Trademarks, and Trade Dress

Unless otherwise noted, all Contents are copyrights, trademarks, trade dress and/or other intellectual property owned, controlled, leased, or licensed by IVOX MUSIC or by third parties who have licensed their materials to IVOX MUSIC and are protected by U.S. and international copyright laws. The compilation of all Contents on the Site is the exclusive property of IVOX MUSIC and is also protected by U.S. and international copyright laws. All Contents on the Site that may not be exclusive property of IVOX MUSIC, or that may be licensed to IVOX MUSIC by third parties is the exclusive property of their respective and legal copyright, trademark, trade dress and/or other intellectual property owners and are also protected by U.S. and international copyright laws.

7. User Content

If you submit reviews, comments, or other content ("User Content") through the Site or Service, you grant IVOX MUSIC a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such User Content in connection with the Site and Service. You represent that your User Content does not infringe on any third-party rights or violate applicable laws.

8. Termination

We may terminate or suspend your access to the Site and/or Service at our discretion, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Site and Service will cease immediately and accordingly you will be denied access to the Site and Service. You may terminate these Terms and Conditions of Use at any time, provided that you discontinue any further use of the Site and Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. IVOX MUSIC does not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

  • To the fullest extent permitted by law, IVOX MUSIC and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim, after adjudication by a court of competent jurisdiction, will not exceed the amount you paid us, if any, for the Service in the preceding 12 months.

BY USING THE SITE AND SERVICE, YOU EXPRESSLY AGREE THAT SUCH USE IS AT YOUR SOLE RISK. THE SITE AND SERVICE ARE PROVIDED ON AN "AS IS", "AS AVAILABLE" AND “WITH ALL FAULTS” BASIS. NEITHER IVOX MUSIC NOR ANY OF ITS RESPECTIVE COMPANY AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, THIRD-PARTY CONTENT PROVIDERS, DESIGNERS, CONTRACTORS, DISTRIBUTORS, MERCHANTS, CONTRIBUTORS, SPONSORS, LICENSORS OR THE LIKE (COLLECTIVELY, "ASSOCIATES") WARRANT THAT USE OF THE SITE, SERVICE OR RELATED SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. NEITHER IVOX MUSIC NOR ITS ASSOCIATES WARRANT THE ACCURACY, INTEGRITY, COMPLETENESS, AVAILABILITY OR TIMELINESS OF THE CONTENT PROVIDED IN THE SITE OR THE MATERIALS OR SERVICES OFFERED, IF ANY, IN OR ON THE SITE AND/OR SERVICE NOW OR IN THE FUTURE. IVOX MUSIC AND ITS ASSOCIATES SPECIFICALLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF THE SITE, INFORMATION ON THE SITE OR THE RESULTS OBTAINED FROM USE OF THE SITE OR RELATED SERVICES.

UNDER NO CIRCUMSTANCES WILL IVOX MUSIC OR ITS ASSOCIATED COMPANIES, AFFILIATES, AGENTS, OR ASSOCIATES, BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR OTHER INDIRECT DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSSES, UNAUTHORIZED ACCESS, SYSTEMS FAILURE, COMMUNICATIONS LINE FAILURE, INTERNET FAILURE OR DAMAGES THAT RESULT FROM USE OR LOSS OF USE OF THE SITE OR SERVICE, CONTENT, INCONVENIENCE OR DELAY. THIS IS TRUE EVEN IF IVOX MUSIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES.

  • Any Content downloaded, watched, viewed, seen, heard, listened to, or otherwise obtained in any way through the Site or Service is done at your own discretion and risk and you are solely responsible for any damage to your computer or other electronic system or loss of data that results from the download of any such Content. The foregoing limitation of liability will apply in any action, whether in contract, tort or any other claim or theory of law, even if an authorized representative of IVOX MUSIC has been advised of or should have knowledge of the possibility of such damages.

11. Indemnification

You agree to:

  • Indemnify and hold IVOX MUSIC harmless from any claims, losses, damages, or expenses (including legal fees) arising out of your use of the Site and Service, your violation of these Terms, or your infringement of any third-party rights.

Your use of the Site and/or Service:

  • Is conditioned on your agreement to indemnify and hold IVOX MUSIC and its Affiliates, Associates, and any company, entity, officer, employee, person, agent, or those working at their direction harmless from and against any and all claims, losses, liability, costs and expenses (including but not limited to attorney’s fees), as incurred, arising from your use of the Site, Service, or related services or from your violation of these Terms and Conditions of Use.

12. Governing Law and Dispute Resolution

  • If these terms are entered into with IVOX MUSIC LLC and the service is licensed within the United States, they shall be governed by and interpreted in accordance with the internal laws of the State of Nevada. No choice-of-law or conflict-of-law provisions or rules shall apply in a way that would require or allow the laws of any jurisdiction other than Nevada to govern." Any disputes arising under these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

  • If these terms are agreed upon with IVOX MUSIC UK Ltd., they, along with any dispute or claim—whether contractual or non-contractual—arising from or related to their subject matter or formation, shall be governed and interpreted in accordance with the laws of England and Wales. In the event of a dispute, both parties shall seek an amicable resolution. Additionally, each party acknowledges that the courts of England and Wales hold exclusive jurisdiction over any such dispute or claim.

  • If any provision of these Terms and Conditions of Use is held to be unenforceable, such provision will be reformed only to the extent necessary to make it enforceable. The failure of IVOX MUSIC to act with respect to a breach of these Terms and Conditions of Use by you or others does not constitute a waiver and will not limit IVOX MUSIC’s rights with respect to such breach or any subsequent breaches.

13. Arbitration

  • By using the Site, you agree that IVOX MUSIC, at its sole discretion, may require you to submit any disputes arising from the use of the Site and/or Service, related services or these Terms and Conditions of Use concerning or, including disputes arising from or concerning their interpretation, violation, nullity, invalidity, non-performance or termination, as well as disputes about filling gaps in this contract or its adaptation to newly arisen circumstances, to final and binding arbitration under the International Rules of Arbitration of the American Arbitration Association, by one or more arbitrators appointed in accordance with the said rules.

  • Notwithstanding these rules, however, such proceeding shall be governed by the laws of the state of Nevada. Additional information regarding our privacy policies with respect to the Site and Service are available in our Privacy Policy posted on the Site.

14. International Use

The Service is intended for users worldwide. By using the Service, you agree to comply with all applicable local laws, including those regarding online conduct and data protection.

15. Site Security

  • You may not violate or attempt to violate the security of the Site and Service. Tampering with any portion of the Site and Service, providing untruthful or inaccurate information, misrepresenting your identity, or conducting fraudulent activities on the Site and Service, whether or not through the use of agents, artificial intelligence (“AI”), or others, are prohibited and constitute a breach of these Terms and Conditions of Use.

  • You are prohibited from violating or attempting to violate the security of the Site and Service, including, without limitation, (a) accessing data not intended for you or logging onto a server or an account which you are not authorized to access; (b) disabling, removing, defeating, or avoiding any security device or system, including, without limitation, any password and login functionality used to authenticate users; (c) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; (d) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Site and Service, overloading, "flooding," "spamming," "mailbombing" or "crashing;" (e) sending unsolicited email, including promotions and/or advertising of products or services; (f) forging any TCP/IP packet header or any part of the header information in any email or posting; (g) using or attempting to use any engine, software, tool, AI, agent or other device or mechanism (including, without limitation, browsers, spiders, robots, avatars or intelligent agents) to navigate or search the Site and Service other than the search engine and search agents available on the Site and Service, and other than generally available third party web browsers; (h) reverse engineering, decompiling or disassembling the underlying software; (i) removing any notices, warnings, labels, annotations or instructions from any portion of the Site, Service, or any related material, including, without limitation, any patent, trademark, copyright, or other proprietary notices or license provisions; or (j) otherwise invading the privacy of, obtaining the identity of, or obtaining any personal information about any user of the Site and Service.

  • Any violations of system or network security including attempts to intentionally access a computer without authorization or exceed your authorized access level may result in civil and criminal charges, including but not limited to charges under the Computer Fraud and Abuse Act (18 U.S.C. §1030). IVOX MUSIC may investigate occurrences that might involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. We may, without prior notice or warning of any kind, restrict or terminate the access of any and all users to the Site and Service if we reasonably conclude that such restriction or termination is necessary to prevent, or prevent the further spread, of a virus, security breach or system malfunction.

16. Our Commitment to Privacy

  • As outlined and set forth in the IVOX MUSIC Privacy Policy, your privacy is important to us. The Privacy Policy is intended to help you understand what information we collect, how we use the information we collect, and how you can update, manage and delete your information.

We use the personal information we collect to operate the Site and Service and perform essential business operations. We do not collect any special categories of personal information about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). The IVOX MUSIC Site and Service is provided through Internet websites or distribution platforms operated by other companies. For example, you can access the IVOX MUSIC Site and/or Service through our website(s) and using third party Apps we make available for Internet-connected consumer electronics devices. Websites and platforms like these may list or promote our name or logo, but they are not operated or maintained by us, and we are not responsible for the privacy practices of the websites or platforms operated by third parties. If you are using the IVOX MUSIC Site or Service on another website or platform, you should check the terms and conditions and privacy policy of the other website(s) or platform(s) to determine how it/they handle any information it collects from or about you.
